Wrongful Termination: California is an at-will employment state, but at-will has major exceptions. Your employer cannot fire you for a discriminatory reason, in retaliation for exercising your rights, or in violation of public policy. If your firing felt sudden, pretextual, or connected to something you reported or requested, you may have a wrongful termination claim.
Severance Agreements: A severance agreement is a contract, and the first offer is rarely the best one. Before you sign away your right to sue, have an attorney review the release language, non-disparagement terms, and the amount offered. We review severance packages and negotiate for better terms where the facts support it.
Discriminación y acoso
Discrimination: California's Fair Employment and Housing Act (FEHA) prohibits treating employees worse because of race, age, gender, national origin, religion, sexual orientation, gender identity, disability, and other protected characteristics. FEHA applies to employers with as few as 5 employees and offers broader protection than federal law.
Workplace Harassment: When slurs, insults, intimidation, or abuse based on a protected characteristic become severe or pervasive, they create a hostile work environment that California law prohibits. You do not have to endure it as "part of the job," and your employer has a legal duty to prevent and correct it.
Sexual Harassment: Unwanted advances, sexual comments, groping, and requests for sexual favors tied to job benefits are all unlawful. This includes quid pro quo harassment by supervisors and hostile environments created by coworkers, managers, or even customers. These cases demand both sensitivity and aggressive advocacy, and we bring both.
Cancer Discrimination and Employment Rights: A cancer diagnosis is hard enough without losing your job over it. Cancer and related medical conditions are protected under FEHA, and you have rights to reasonable accommodations, medical leave, and freedom from discrimination during and after treatment.
Represalias y denuncia de irregularidades
Retaliation: Your employer cannot punish you for doing something the law protects: reporting harassment or discrimination, complaining about unpaid wages, filing a workers' compensation claim, taking protected leave, or reporting illegal activity. Retaliation can look like termination, but also demotion, schedule cuts, bad reviews, or sudden write-ups that follow your complaint.
Whistleblower Actions: If you reported fraud, unsafe conditions, or other illegal activity, California and federal law protect you, and some laws reward you. From qui tam actions under the False Claims Act to SEC and Cal/OSHA complaints, we help whistleblowers do the right thing without sacrificing their careers.
Salarios y condiciones laborales
Wage & Hour: California's Labor Code goes far beyond federal wage law. You are generally entitled to daily overtime after 8 hours, double time after 12, meal and rest breaks with premium pay when they are denied, accurate wage statements, and your full final paycheck on time. We pursue unpaid overtime, off-the-clock work, misclassification, and minimum wage violations.
Permisos, discapacidad y familia
Disability & Leave Rights: If you have a disability or serious medical condition, your employer must engage in a good-faith interactive process and provide reasonable accommodations. California's CFRA leave protections apply to employers with just 5 employees, far more workers than federal FMLA covers. Being fired while on medical leave, or denied leave you qualified for, may be unlawful.
Pregnancy Rights: Pregnant workers in California are entitled to reasonable accommodations, up to 4 months of Pregnancy Disability Leave (PDL), and CFRA baby-bonding leave on top of that. Demotion, termination, or sidelining after announcing a pregnancy is discrimination, and it remains one of the most common violations we see.
