Minimum Wage Violations

Minimum Wage Violations

Minimum wage is supposed to be the floor nobody falls through. Yet in Los Angeles, thousands of workers are paid below it every pay period: dishwashers paid a flat daily amount that works out to less than minimum wage, garment workers paid by the piece, car wash and caregiving staff with hours that never fully make it onto the check, and tipped servers whose employers wrongly believe tips can substitute for wages.

Here is what many workers do not know: in Los Angeles, the state minimum wage is often not even the right number. The City of Los Angeles and unincorporated Los Angeles County each set their own minimum wage ordinances above the California state floor, several other cities in the county (including Santa Monica, West Hollywood, and Pasadena) have their own rates, and separate, higher rates apply to certain hotel workers and healthcare workers. The rates adjust regularly. [VERIFY current LA City, LA County, and state minimum wage rates before publishing; do not state dollar figures without confirming.] If your employer is paying the wrong jurisdiction's rate, you are owed the difference, plus more.

Labor Law PC is an employee-only firm headquartered in Santa Monica. Our minimum wage lawyers pursue every dollar the law provides, and California law provides a lot more than just back pay. Call (877) 775-2267 for a free, confidential consultation.

Minimum Wage in Los Angeles: More Than One Law Applies

The layered system

Three layers can apply to a single job, and you are entitled to the highest rate that covers you:

  • California state minimum wage, set by the Labor Code and adjusted for inflation.
  • Local ordinances: the City of Los Angeles and unincorporated LA County have their own minimum wage ordinances with annual adjustments, and cities such as Santa Monica, West Hollywood, Malibu, and Pasadena have adopted their own. Which one applies generally depends on where you actually perform the work, not where the company is headquartered.
  • Sector-specific rates: Los Angeles has a higher citywide minimum wage for workers at large hotels, and California has enacted higher minimum wages for many healthcare facility workers and fast food workers at large chains. [VERIFY which sector ordinances and statutes apply and current rates.]

A janitorial company based in another state, a staffing agency, or a franchise owner may simply run payroll at the state rate, or even the federal rate, for everyone. In Los Angeles, that is a violation with every paycheck.

Rules that make California's floor stronger

  • Tips do not count toward minimum wage. California prohibits tip credits. A server, bartender, or valet must receive the full applicable minimum wage from the employer, with tips on top.
  • Piece rates and day rates must still average out. Garment work is a special case: California's Garment Worker Protection Act generally requires garment workers to be paid an hourly wage rather than by the piece, with brands potentially sharing liability. In other industries, piece and day rates are lawful only if pay covers all hours, including required paid rest breaks and nonproductive time.
  • Every hour counts on its own. Underpaying some hours cannot be excused by overpaying others; minimum wage is owed for each hour worked.
  • Deductions cannot drop you below the floor. Charging you for uniforms, tools, cash register shortages, or breakage that pushes effective pay below minimum wage is unlawful.
  • Unpaid "training," "trial shifts," and off-the-clock work are minimum wage violations for those hours, since the rate paid for them is zero.

The penalty stack

Minimum wage claims carry some of the strongest remedies in the Labor Code. In addition to the unpaid wages themselves, workers may pursue liquidated damages generally equal to the unpaid minimum wages, effectively doubling the shortfall in many cases, plus interest, wage statement penalties, waiting time penalties of up to 30 days of wages if employment ended, civil penalties through PAGA where applicable, and attorney's fees. Unpaid wage claims generally look back three years, and up to four through the Unfair Competition Law; some penalty claims are shorter. Deadlines vary, so ask before you assume.

Signs You Are Being Paid Below Minimum Wage

  • Your pay divided by the hours you actually worked comes out below the LA City, LA County, or applicable local rate.
  • You are paid a fixed daily or weekly amount no matter how long you work.
  • You are paid by the piece, per delivery, per garment, or per room, with no hourly reconciliation.
  • Tips or "service charges" are treated as part of your wage.
  • Paycheck deductions for uniforms, equipment, shortages, or "fees" shrink your effective hourly rate.
  • You work at a hotel or healthcare facility and are paid the general minimum wage instead of the higher sector rate. [VERIFY applicability]
  • You work in the City of LA, Santa Monica, or West Hollywood but are paid the lower state rate.
  • Some of your hours (setup, closing, travel between sites, mandatory meetings) never appear on your check at all.

How We Recover Minimum Wage Shortfalls

  1. Free consultation. Bring pay stubs if you have them; if you do not, that itself is often a violation. We identify the correct rate for where and what you work.
  2. Reconstructing hours. We use time records, schedules, texts, GPS and app data, and your testimony. Employers who fail to keep required records cannot benefit from their own missing paperwork.
  3. Full damages calculation. Shortfall, liquidated damages, interest, and every stacking penalty, not just the difference in hourly rates.
  4. Enforcement. Demand, Labor Commissioner wage claim, or civil action in Los Angeles courts. Where a pay practice hits a whole crew, kitchen, or facility, we evaluate class and PAGA options.
