LGBTQ Discrimination
Los Angeles has one of the largest and most visible LGBTQ communities in the country, and California has the strongest workplace protections in the nation for sexual orientation, gender identity, and gender expression. That does not mean discrimination is gone. It means that when a manager deadnames you, a promotion disappears after you mention your husband, or a client's "discomfort" gets you pulled from an account, the law is squarely on your side.
Labor Law PC represents employees only. Our attorneys handle LGBTQ discrimination cases across LA's industries: production and post-production shops where "fit" suddenly becomes an issue after someone comes out, hospitals and clinics where transgender staff face misgendering and restroom policing, restaurants and hotels from West Hollywood to Long Beach where expression is policed by dress codes, and corporate and tech workplaces where bias hides behind performance language.
You do not have to tolerate being treated as a problem for being who you are. Call (877) 775-2267 for a free, confidential consultation. No fees until we win.
Signs of LGBTQ Discrimination at Work
- Changed treatment after coming out: assignments, reviews, or advancement shifting once your orientation or identity becomes known.
- Misgendering and deadnaming: persistent, intentional refusal to use your name or pronouns, especially by supervisors or after correction.
- Restroom and facility policing: being barred from facilities consistent with your gender identity.
- Dress code enforcement against expression: grooming and appearance rules applied to punish gender expression rather than any legitimate standard.
- Exclusion from customer or client work: taken off accounts because a client is "uncomfortable," or hidden from public-facing roles.
- "Jokes," slurs, and invasive questions about your body, transition, relationships, or sex life.
- Benefits discrimination: spousal or family benefits administered differently for same-sex spouses or partners.
- Outing and gossip: managers disclosing your orientation, identity, or transition status without your consent.
- Retaliation after you report any of the above.
If hostile conduct is severe or pervasive, you may also have a workplace harassment claim alongside discrimination.
Your Rights Under California Law
FEHA Explicitly Protects Sexual Orientation, Gender Identity, and Gender Expression
California's Fair Employment and Housing Act (FEHA) expressly prohibits employment discrimination based on sexual orientation, gender identity, and gender expression, in addition to sex and gender. This is written into the statute itself, not inferred, and it has been California law since long before the U.S. Supreme Court's Bostock decision extended federal Title VII to LGBTQ workers.
California's protections are broader in practice:
- Five-employee coverage. FEHA reaches employers with five or more employees; Title VII requires 15.
- Gender expression is protected on its own. How you dress, groom, and present is protected even apart from your identity or orientation, and employers who impose gender-based dress codes must allow employees to dress consistently with their gender identity.
- Perception and association count. You are protected if you are perceived as LGBTQ (accurately or not) or discriminated against for associating with LGBTQ people.
- No damages caps. FEHA does not carry Title VII's caps on compensatory and punitive damages.
Transgender and Nonbinary Workers' Rights
California Civil Rights Department guidance and regulations make specific rights clear: employees are entitled to use restrooms and facilities corresponding to their gender identity; employers must honor an employee's identified name and pronouns in workplace communications where reasonably possible; and inquiries into transition status, anatomy, or medical history are off-limits in employment decisions. Deliberate, repeated misgendering can be evidence of discrimination or harassment.
Deadlines
You generally have three years from the most recent discriminatory act to file with the California Civil Rights Department (CRD), the required step before a FEHA lawsuit, then a limited period to sue after your right-to-sue notice. Federal deadlines are shorter, and every case has its own timing issues, so speak with a lawyer promptly.
How Your Case Would Proceed
- Free, confidential consultation. You talk, we listen, and we tell you honestly whether the facts support a claim. Nothing is filed without your decision.
- Evidence building. We collect messages, reviews, witness accounts, policy documents, and comparisons showing how you were treated before and after your employer learned who you are.
- CRD filing. We handle the administrative complaint and right-to-sue process.
- Resolution. We pursue full value in negotiation or mediation, and we are prepared to try your case in Los Angeles courts if the employer refuses to be fair.
What You May Recover
Depending on the facts, LGBTQ discrimination claims can seek lost wages and benefits, front pay where returning is not viable, emotional distress damages (often significant where outing, misgendering, or humiliation is involved), punitive damages in egregious cases, and attorney fees under FEHA. No lawyer can promise results; what we offer is a rigorous, judgment-free evaluation at no cost.
No Fees Until We Win
The consultation is free and confidential, and we take these cases on contingency. You pay nothing up front, and our fee comes only out of what we recover for you.
Frequently Asked Questions
-
Is misgendering by my boss actually illegal?
Isolated slips are not usually actionable, but deliberate, repeated refusal to use your name and pronouns, especially after correction, can be evidence of discrimination or harassment under FEHA. Context and persistence matter, and a lawyer can assess where your situation falls.
-
Can my employer stop me from using the restroom matching my gender identity?
No. California law entitles employees to use facilities corresponding to their gender identity, and California requires single-occupancy restrooms in businesses to be designated all-gender. Facility policing is a common thread in successful claims.
-
I work at a small company with 8 employees. Am I protected?
Yes. FEHA's discrimination protections start at five employees, and its harassment protections apply to employers of any size. Small size does not exempt your employer.
-
A client asked that I be taken off their account because I am gay. My employer agreed. Is that legal?
No. Customer or client preference is not a defense to discrimination in California. An employer that trades away your opportunities to appease a biased client is itself discriminating.
-
Can religious beliefs of a coworker or owner justify treating me differently?
An employer must accommodate religious practice, but accommodation cannot come at the price of discriminating against or harassing LGBTQ employees. These situations are legally nuanced; see our religious discrimination page and talk to a lawyer about your specific facts.
