Berkeley's economy is unusual for a city its size. It is anchored by one of the world's great research universities and the labs, institutes, and startups that grow around it, layered over a dense restaurant, cafe, and retail scene along Telegraph, Shattuck, and Fourth Street, plus a deep bench of nonprofits and public agencies. White collar, service, and academic-adjacent work each come with their own ways of being underpaid or pushed out, and Berkeley workers see all three.
Labor Law PC represents employees only, never employers. We are headquartered in Santa Monica with a Bay Area office in Palo Alto, and we represent East Bay workers primarily by phone and video, appearing in the Alameda County courts when a case requires it. The consultation is free and confidential. Call (877) 775-2267 or reach us online. Hablamos Español.
A note on UC Berkeley itself: the university is a public entity with its own internal complaint systems, civil service rules, and union contracts, and claims against it follow special procedures and deadlines, including government claim requirements. If your employer is the university, talk to us early; those deadlines are short and unforgiving.
Berkeley sits in Alameda County, so an employment lawsuit for a Berkeley worker is generally filed in the Superior Court of California, County of Alameda, which hears most civil cases at the Rene C. Davidson Courthouse in downtown Oakland. Federal claims go to the Northern District of California, which also sits in Oakland.
On top of FEHA and the Labor Code, Berkeley is one of the California cities with its own local minimum wage ordinance, set above the state floor, along with local paid sick leave rules. If a Berkeley employer pays only the state minimum, that is a violation, and it usually is not the only one on the paystub. See minimum wage violations.
Statewide protections apply in full: FEHA discrimination and harassment coverage from 5 employees, whistleblower protection under Labor Code section 1102.5 (which matters in research settings, where reporting data or grant compliance problems is protected), CFRA family leave, and waiting time penalties for late final paychecks.
We represent employees only, statewide, on contingency. For Berkeley workers that means a firm with no ties to local institutions, no conflicts with the university, the labs, or the employers on either side of the bay, and no fee unless we recover for you. Meetings happen on your schedule by video, and our Palo Alto office anchors us in the Bay Area when in-person matters.
Your case evaluation is free, confidential, and privileged. We work on contingency, advance all costs, and collect only as a percentage of what we recover. No recovery means you owe nothing.
No. California uses the ABC test, which presumes you are an employee unless the company proves otherwise. The label on your paperwork carries little weight against how the job actually works.
Generally, hours worked within Berkeley city limits must be paid at the city's rate, which exceeds the state minimum. The current rate adjusts over time, so check the city's published figure or ask us.
Yes. FEHA applies from 5 employees, harassment protections reach smaller employers still, and wage and hour law applies to nearly everyone. Mission does not create an exemption.
Whether the problem is a misclassified role, a shorted paycheck, or a termination that followed a complaint, find out what your rights are worth. Call (877) 775-2267 or request your free case evaluation. Hablamos Español.
No Win, No Fee.
Every case gets a team that listens, keeps you informed, and fights like it matters. Because to you, it does.
If something about how you were treated at work feels wrong, trust that instinct. Deadlines are running, and the earlier we start, the stronger your case. You pay nothing unless we win.
